Statewide AT Programs work with their Advisory Councils to plan and implement the four core state level activities and the state leadership activities through their state plan. All states will implement the four state level activities unless they utilize the comparability or flexibility provision allowed by the AT Act.
Comparability - Sec. 4(e)(1)(B) of the act allows states to not conduct one of the four state-level activities if that activity is supported comparably with nonfederal funds.
Flexibility - Sec. 4(e)(6) of the act gives states the “flexibility” to carry out only two or three state-level activities.
States that carry out all four state-level activities may use up to 40% of their federal funds for state leadership activities. States that utilize flexibility and carry out less than all four state-level activities may only use up to 30% of funds for state leadership activities.
All states implement the required state leadership activities without exception.
